## If you are outside Ernakulam

Papers can move digitally. Orders, notices and representations can be sent by email, conferences can take place over video or phone, and the petition is e-filed with the High Court from my office at High Court Junction, Ernakulam. A visit to Ernakulam is needed only when a hearing requires it. The Registry, the causelist and the orders are the same wherever the petitioner lives, so what matters is a complete paperbook: the impugned order, every representation with its receipt, and a date-wise chronology. ## Commercial matters before the High Court

Business disputes also reach the High Court of Kerala: appeals from the Commercial Court to the Commercial Appellate Division, applications to appoint an arbitrator under Section 11 and appeals under Section 37 of the Arbitration and Conciliation Act, writ petitions on SARFAESI action in the narrow cases where a writ lies, and challenges to orders of statutory authorities affecting a business. How it proceeds

## How does a matter proceed?

1.  **Representation first.** Most writs need a written representation to the authority and proof that it was delivered. The petition then shows the demand and the refusal or silence that followed.
2.  **Maintainability check.** I check whether the body performs a public function, whether a statutory appeal or forum such as the CGRF is available, and whether any delay can be explained, before drafting.
3.  **E-filing and Registry defects.** The W.P.(C) or OP(C) is e-filed with the affidavit and exhibits. Defects noted by the Registry are cured so the matter is numbered and listed.
4.  **Admission and interim relief.** At admission the court may issue notice, call for a statement or grant interim relief. Urgent matters are mentioned, including before the vacation bench.
5.  **Counter, hearing and after judgment.** After the counter-affidavit and reply, the matter is heard. A writ appeal within 30 days, or contempt within one year of disobedience, follows the judgment where needed.

## Common questions

**When is a writ petition the right remedy?**

When a public authority acts illegally, unfairly or not at all, and no equally effective alternative remedy exists. Writs are not a substitute for appeals, or for suits between private parties.

**Can I file a writ petition against KSEB or a university?**

Yes, where the body performs a public function, as KSEB and state universities do. For KSEB billing and connection disputes, the CGRF and Ombudsman route is usually expected first, and the petition must explain why it is inadequate.

**What is the time limit for a writ appeal in Kerala?**

Thirty days from the Single Judge's judgment, under Article 117 of the Limitation Act, 1963. The appeal lies to a Division Bench under s.5 of the Kerala High Court Act, 1958, and delay needs a condonation petition.

**How long do I have to file a contempt petition?**

One year from the date of the alleged contempt, under s.20 of the Contempt of Courts Act, 1971. An appeal against a Single Judge's contempt order lies to a Division Bench within 30 days under s.19.

**How long is a caveat valid in the High Court?**

Ninety days from filing, under s.148A of the Code of Civil Procedure. It entitles the caveator to notice before an interim order is passed; it does not stop the court from passing orders.

**What is the time limit for an election petition?**

Forty-five days from the date of election of the returned candidate, under s.81 of the Representation of the People Act, 1951. Only the High Court hears it (s.80A), and a late petition is dismissed under s.86(1).
